PHC disposes of petition in girl kidnapping case

A division bench of the PHC, comprising Chief Justice Tariq Pervez Khan and Justice Saleem Khan, was taking up a petition filed by one Wasil Khan, seeking production of her ‘kidnapped’ sister, Khalida.

Assistant Political Agent Amjad Ali told the court that he had constituted a Jirga, with political tehsildar as its member, to probe into the alleged abduction of the girl. “The Jirga was provided with photographs, depicting the girl as signing the marriage deed (Nikahnama),” he added.

The APA added that he had also rounded up some 12 tribesmen, hailing from the tribe sheltering the accused, under Section 21 of the Frontier Crimes Regulation.

During the previous hearing of the case, the PHC had ordered the Yaka Ghund APA to record the statement of the ‘kidnapped’ girl in presence of her siblings.

The APA on the previous hearing had also informed the court that the girl had told a tribal Jirga that she had willingly contracted marriage with her cousin, Niqab Shah, who, according to the family members of the girl, had kidnapped her some five months ago.

However, the brother of the girl, Wasil Khan, had requested the court to order the APA to issue production orders of the girl and record her statement in presence of her brothers.

“We will honour her decision if she admits having entered wedlock of her own will with the accused,” Wasil had contended before the court.

Wasil Khan had filed an application with the PHC, seeking release of his sister from what he called the illegal confinement of abductors after receiving deaf-ear response from the political administration despite repeated efforts.

It will be pertinent to recall that Khalida was allegedly kidnapped by some influential people of her village Moti Banda from the jurisdiction of Lund Khwar Police Station.

The kidnapped girl, a Bachelor of Education student of the Institute of Education and Research, University of Peshawar, was on her way home from the varsity along with her brother, Wasil Khan, when some armed men intercepted the vehicle they were travelling in and abducted her.
