Rapist gets 10 years in prison

KARACHI: A sessions court on Wednesday sentenced a man to 10 years in prison for raping a nine-year-old girl.

The court found 55-year-old Ashiq Hussain guilty of subjecting the girl to a sexual assault within the remit of the Sharea Faisal police station in 2005.

Additional District and Sessions Judge Aftab Ahmed pronounced his judgment after recording evidence and final arguments from both sides.

The court observed in its judgment that the prosecution proved its case against the accused by producing ample evidence in court.

It added that the victim had recorded her statement against the accused before a judicial magistrate under Section 164 of the criminal procedure code and it was corroborated by the testimonies of prosecution witnesses and medical evidence.

The court extended the benefit of Section 382-B (period of detention to be considered while awarding sentence of imprisonment) of the CrPC to the convict.

The prosecution said that the victim along with her parents was residing in a hut within the jurisdiction of the Sharea Faisal police station. On July 13, 2005 the accused took the girl to his hut and subjected her to a sexual assault.A case (FIR 245/05) was registered against the accused under Section 10(2) of the Offence of Zina (Enforcement of Hudood) Ordinance on the complaint of the victim’s father. Later, Section 10 was replaced with Section 376 (punishment for rape) of the Pakistan Penal Code. The police arrested the accused the following day.

The accused was produced in court in custody and was remanded back to the prison along with conviction warrants to serve out the remainder of his sentence.
