LAHORE: An additional district and sessions court Monday dismissed post-arrest bail petition filed a man accused of raping a three-year-old girl.

Accused Khuram Shehzad had filed the petition on the ground that a compromise had been affected between both the parties.

The counsel for the accused contended the court that complainant submitted an affidavit contending that compromise has been occurred between both the parties and he does not want to pursue this bail petition.

On the other hand prosecutor strongly opposed the bail petition stating that the petitioner is nominated in the FIR and he was caught red-handed. Moreover, the medical evidence is also available on the file, so the accused is not entitled to the grant of the post arrest bail.

It is worth mentioning that the accused had filed bail only on the ground of compromise as an affidavit has been occurred between the accused and father of the victim. The judge mentioned in the order that sections 376 and 377 PPC are non compoundable offences even otherwise age of the victim baby is just 3 years old, moreover, no compromise can be made on behalf of the minor child particularly when the age of the victim is just 3 years as she has no understanding and capacity to do the same. The medical evidence is available in the file. The accused committed this odious, obnoxious and devilish act which is not only against the body of the victim but also an offence against the whole society. According the FIR got registered by Ali Ahmed, father of the victim, in Shahdra Police Station against accused Khuram Shehzad stating he had good relations with the family of the accused. On November 9, 2013, his daughter did not come home and he along with others started her search, they came to know that the accused took her daughter to his home. They visited there and found the accused raping the girl. They caught him red-handed and handed him over to police.
