Supreme Court of Pakistan orders arrest of absconders in freewill couple kidnap case

KARACHI: The Supreme Court of Pakistan (SCP) on Friday directed senior superintendent police (SSP), Karachi, to arrest and produce two accused absconding in case pertaining to kidnap of a freewill couple declared karo-kari (liable to be killed for honour) since 2009.

A two-member bench, comprising Justice Anwar Zaheer Jamali and Justice Amir Hani Muslim, also ordered taking back investigation of case from investigation officer (IO) for failing to make progress in case despite lapse of many months.

Petitioner Amirzadi moved apex court to seek orders for recovery of her son and daughter-in-law missing since June 2009. She submitted her son Israr Ahmed and Fakharunnisa Narejo solemnised marriage against consent of her family after executing freewill before Justice of Peace at Karachi.

She stated relatives of her daughter-in-law declared couple karo-kari and kidnapped them from Masjid Babul Ilm. Since then their whereabouts were not known. She said they lodged a kidnap case (FIR 314/2009) under sections 365, 506-B and 34 Pakistan Penal Code at Shahrah-e-Noor Jehan police station, nominating Ali Akbar, Asghar Ali, Amir Ali, Rab Nawaz, Haq Nawaz, Abdul Latif Narejo, Ghulam Rasool Narejo and Mukhtar Ali Narejo, as persons involved in kidnap.

On April 27 Additional Sessions Judge Central convicted five accused Ali Akbar, Asghar Ali, Amir Ali, Rab Nawaz, Haq Nawaz and Abdul Latif Narejo to five years rigorous imprisonment and fine of Rs 5,000 each for being guilty of kidnapping couple.

Petitioner contended police failed to recover her son and daughter-in-law, whom accused might have murdered on charge of honour. Police also failed to arrest two accused, kidnapped girl’s father Ghulam Rasool Narejo and Mukhar Ali Narejo, who were still absconding in the case.

On Friday, IO Mobin appeared and submitted efforts were being made to arrest absconding accused. He expressed apprehension that kidnapped couple might have been killed, as no clue of them was traced as yet.

Expressing annoyance over poor performance of Mobin, SC bench directed Karachi Police authorities to take back investigation from him and assign same to a competent officer. Apex court also directed holding fresh investigation under supervision of SSP Karachi Police Niaz Khoso with direction to arrest absconding accused and produce them on before court.

Work on deputation case: The SCP on Friday also dismissed appeals of former secretary Sindh Local Government Department and deputy director Federal Investigation Agency, who sought continuation of their work on deputation.

A two-member bench, comprising Justice Anwar Zaheer Jamali and Justice Amir Hani Muslim, directed to relinquish their present posts and join previous posts in their parent departments, from where they were inducted on deputation.

The bench was hearing suo moto case against non-repatriation of officers, who were inducted in Sindh government departments on deputation in violation of orders passed by apex court.
