KARACHI: A district and sessions court (south) on Thursday recorded statements of the accused in the gang-rape case of an 18-year-old girl.
Ali Hasan, Abdul Jabbar, Shah Zado, Bashir Ahmed, Anwar Hussain, Khadim Hussain, Abdul Sattar and Shah Baig have been charged with kidnapping Naseema Lubano from her house in district Gotki in January 2007 and subjecting her to sexual assault.
In their statements, the accused denied all the charges levelled against them by the prosecution, saying that they had been framed in the case due to an old enmity between the elders of the complainant and their grandparents.
A case (FIR No.07/07) was registered under Section 10(4) (when zina-bil-jabr liable to tazir is committed by two or more persons in furtherance of common intention of all each of such persons shall be punished with death) of the Offence of Zina (Enforcement of Hudood) Ordinance, 1979 and under Sections 354-A (assault or use of criminal force to woman and stripping her of her clothes), 452 (house-trespass after preparation for hurt, assault or wrongful restraint), 147 (punishment for rioting), 337-A(i) (shajjah-i-khafifah to any person, shall be liable to daman and may also be punished with imprisonment of either description for a term which may extend to two years as ta’zir,) and 337-F(i) (damihah to any person, shall be liable to daman and may also be punished with imprisonment of either description for a term which may extend to one year as ta’zir;) of the Pakistan Penal Code (PPC) at the Ubaro police station on the complaint of the victim’s father.
Later, Section 10(4), of the Hudood ordinance was replaced with the new Section 376-B (when rape is committed by two or more persons in furtherance of common intention of all, each of such persons shall be punished with death or imprisonment for life) of the Protection of Women (Criminal Laws Amendment), Act, 2006.
Two accused, Manawar Hussain and Moro Zada, charged with the same offences, are absconders in the case.
