Man ‘who killed sister’ acquitted after being pardoned by their father

A sessions court has acquitted a man accused of killing his sister in the name of ‘honour’ after he reached an out-of-court settlement with his (or their) father.

Hakeem Khan had been charged with shooting dead his sister Safia with his licensed pistol at their residence in Defence Housing Authority Phase VI within the jurisdiction of the Darakhshan police station in May 2023.

The accused and his father Ghazi Khan had moved an application before Additional Sessions Judge-III (South) Ashraf Hussain Khowaja under the Section 345 (2) of the Criminal Procedure Code (CrPC) seeking permission to compound the offence.

The judge pronounced his order after hearing arguments from both sides, exonerating Hakeem from the murder charge. He observed that after the persual of the case record, it appeared the offence was a compoundable one and the complainant was the sole legal heir of the victim, who was unmarried, and her mother had already passed away.

“Hence, the required permission under the Section 345 (2) of the CrPC is hereby granted to complainant and accused to compromise the offence,” ruled the judge. The accused was already out on bail.

The victim’s father testified that he had forgiven his son in the name of God and would have no objection if he was acquitted in the present case. “On the basis of misunderstanding and sudden provocation, the FIR was lodged but later on when the accused came out and put the real story before the complainant, both parties compromised and accused patched up the dispute and reached amicable settlement,” read the application.

The state prosecutor did not raise any objection to the compromise plea. According to the prosecution, on May 14, 2023, the accused shot and killed his sister Safia because she wanted to marry of her own free will against the wishes of her family. An FIR was lodged under the sections 302 (murder) and 311 (fasad-fil-arz) of the Pakistan Penal Code (PPC).

Under the Section 311, the trial court has powers to punish an offender in an honour-related offence even if he or she is forgiven by legal heirs of a deceased person. However, legal experts point out that a person could not be sentenced under the Section 311 until he is found guilty of the offence of honour-killing, which is an uphill task given the low standards of investigation and unwillingness of family members to cooperate in such cases.

Woman beaten by cop in train found dead

BAHAWALPUR: The woman, who was subjected to torture by policeman Mir Hasan on a moving train, was found dead near Chani Goth Railway Station in Bahawalpur, police said Monday.

The incident came to light after a video of the policeman went viral on social media, in which he could be seen holding the woman by her hair and hitting her multiple times while other passengers watched silently. Deputy Inspector General of Police (DIG) Railways Abdullah Sheikh had said that the incident took place on April 7 on Karachi to Lala Musa-bound Millat Express. The woman, who belonged to Jaranwala, Faisalabad, was identified as Maryam Bibi.

The victim’s brother, Afzal, said that his sister used to work at a beauty parlour in Karachi and she was coming to Jaranwala to celebrate Eid-ul-Fitr.

Afzal said that Maryam left Karachi on April 7 by Millat Express. He said that the Bahawalpur police informed his family of Maryam’s death, saying she fell from train. “We buried her on April 9 in the village thinking it was a train accident. When the video went viral, the truth behind the incident and the violence on my sister came to the fore,” he added.

Afzal alleged that the policeman tortured and killed his sister and threw her body on a railway track, adding that they requested the police to register a case but no action was taken. Meanwhile, the woman’s nephew who was travelling with her, said that his aunt was reciting loudly to which the policeman objected and started torturing her.

“The policeman took our aunt with him and dropped us at the next station,” said the nephew. Meanwhile, police said that Maryam Bibi’s postmortem was conducted at Tehsil Headquarters Hospital Ahmedpur and they are waiting for the report.

Abducted minor girl rescued within 12 hours

LAHORE   –   The Lahore Police rescued a minor girl abducted from Data Darbar within 12 hours. According to details, a family hailing from Islamabad visited Data Darbar Lahore during which a woman kidnapped five-year-old Fizza. Investigation Incharge Muhammad Siddique said that father of the abducted girl registered an FIR of abduction of his daughter with Data Darbar police station. He said that the kidnapper woman took the girl to Gujranwala and police using CCTV cameras and human intelligence traced the accused. After being chased by police, the kidnapper woman leaving the abducted girl escaped the scene. The girl was rescued safely and handed over to family which thanked and appreciated the performance of police. Superintendent Police Investigation Cell said that teams have constituted to arrest the kidnapper woman and she would be soon in custody of police.
