Human Rights Commission of Pakistan (HRCP) condemns harassment

Lahore: The Human Rights Commission of Pakistan (HRCP) has taken notice of the continued judicial harassment of activist Prof M Ismail and his wife. An HRCP statement issue Sunday said, “For over three years they have been subjected to raids of their homes, fabricated cases and restriction on their freedom with the elderly Prof Ismail forced to serve jail time despite ill health. The state must stop this persecution immediately and guarantee their safe and constitutional freedoms.”

Sindh High Court (SHC) sets aside life imprisonment of man in wife’s murder case

The Sindh High Court (SHC) recently set aside the life imprisonment of a man in a case pertaining to the murder of his wife.

Ansar Khan was sentenced to life imprisonment for strangulating his wife Afshan to death and his mother Anwari Begum and sister Maira were sentenced to six months for attempting to cause disappearance of evidence in order to save themselves from legal consequences by an additional district and sessions court east.

The trial court also acquitted two co-accused, Saba and Hira, after giving them the benefit of the doubt. A counsel for the appellants submitted that they were innocent and had been falsely involved in the case by the complainant party in order to satisfy their grudge against them due to a matrimonial dispute.

The counsel submitted that it was a case of suicide that had been given the cover of murder, even otherwise the incident was not witnessed by anyone, due to which the appellants were entitled to acquittal due to the benefit of the doubt.

An additional prosecutor general supported the impugned judgment and sought dismissal of the instant appeal by contending that the prosecution had been able to prove its case against the appellants beyond any shadow of doubt.

A single bench of the SHC comprising Justice Irshad Ali Shah, after hearing the arguments, observed that the complainant, Mohammad Saleem, had stated that the deceased was his daughter and was married with the appellant.

The high court observed that the complainant had deposed that his wife Shahnaz intimated him that she had noticed mark of violence on the neck of the deceased but Shahnaz had not been examined by the prosecution for no obvious reason and her non-examination could not be overlooked.

The high court observed that a medico-legal officer with whom the complainant initially met and obtained the body of the deceased without a post-mortem had not been examined by the prosecution too.

The bench observed that the investigation officer had admitted that he submitted the charge sheet of the case six months after the registration of an FIR and no explanation was offered by him for that, which reflected adversely on his performance.

The SHC observed that no confessional statement of the appellant was recorded before the magistrate concerned and such omission could not be lost sight of. The high court observed that in the presence of such untrustworthy evidence, it could be concluded safely that the prosecution had not been able to prove its case against the appellants beyond any shadow of doubt.

The bench observed that none of the prosecution witnesses had actually seen the appellants committing the murder. The SHC set aside the life imprisonment of Khan and six-month sentence to the other co-accused, and ordered their release if not required in other cases

Abbottabad women police station functional after 20 years

PESHAWAR: The women police station in Abbottabad has become functional after 20 years after it was provided a record to lodge the first information report (FIR) and daily diary in cases of violence and crimes against women. The police station was inaugurated 28 years ago by former prime minister Benazir Bhutto, but it remained dysfunctional since 2002.

“The women police station has been made functional. A lady assistant sub-inspector (ASI) Fahmeeda Bibi has been assigned the charge of station house officer as no female inspector and sub-inspector was available. A female head constable is also posted muharer along with all the support staff including the wireless operator from ladies police,” District Police Officer (DPO) of Abbottabad Sajjad Khan told The News.

2 constables booked for abducting girl in Lahore

LAHORE: The Defence-C police have arrested two constables and lodged a criminal case against them for illegally detaining and sexually harassing a young working girl.

The incident took place at Defence Housing Authority (DHA) where police constables Irfan Arif and Amir Maqsood stopped the girl (N), detained her for five hours or so, attempted to rape her and then “released” her late in the night.

In the FIR, the girl alleged that she was going back to her home after completing her job at a department store around 7pm. She said she worked there along with her sister to earn livelihood as their father was suffering from an illness.

The girl said her colleague Asif Ali used to drop her home by his bike daily. On the day of incident, she said, the constables stopped the bike and grilled her colleague Asif as to why he was taking a ‘stranger girl’ in the evening.

“I stepped up immediately to rescue my colleague and apprised the police officials that he drops me at my house,” she stated in the FIR. She said the constables turned offensive and harassed Asif in the name of ‘interrogation’ and threatened him with involving him in a fake criminal case.

They later asked Asif to let her go with them for two hours at some place for investigation or pay them Rs10, 000 bribe if he wanted to take her back, she said. The girl added that her colleague was unable to pay the desired amount.

Irfan Arif took her to a deserted place where he attempted to sexually abuse her, she said.

“I strongly resisted his nefarious attempt and raised an alarm”, she said, adding that the other police official later asked Asif to call his relatives to bring money to ‘secure safe release’. Asif’s close relative Zohaib reached the site, paid Rs2, 000 to the policemen who later disappeared, she alleged in the FIR.

As the incident came to the limelight, the IGP took notice and directed the Lahore police senior officers to investigate it and take action in the light of the inquiry report. Police arrested both the constables and registered a case against them.

Woman allegedly tortured, raped

RAWALPINDI: A woman was allegedly subjected to torture and sexual assault by a man in the Airport police area.

In her complaint lodged with the police, the rape victim said her friend called her and asked her to come to the corner of a street as she wanted to meet her. She said she left for the said place in response to her friend’s call.

She said when she reached there, she found her friend standing there while another person was sitting in a car. She said after her friend asked her to accompany her, she sat in the car which entered a house after a short drive. She further said a security guard was also there in the house who informed them that another friend of their’s was sitting on the first floor of the house.

She said as they went upstairs, the man who was accompanying her friend followed her and locked the room as she entered it. She said she was threatened and then subjected to sexual assault.

She further claimed that after she tried to escape, she was overpowered by the security guard and taken into the room again where she was subjected to torture and rape by the suspect who snatched her mobile phone and switched it off. Further investigation is underway.
