Woman ‘forgives’ three policemen in boys’ illegal detention case

KARACHI: A mother, who approached a district and sessions judge against the illegal detention of her son and a nephew, told a sessions court on Tuesday that she had “forgiven” the policemen responsible for holding the two teenagers without any charge.

The mother, Ms Bano, had challenged the illegal detention of her son and her nephew and a judicial magistrate raided the Saudabad police station and recovered the two teenagers from the police station and a nearby office of the special investigation unit.

The sessions court summoned three policemen including the SHO of the Saudabad police station on Tuesday.

However, when the hearing began on Tuesday, Ms Bano appeared before Additional District and Sessions Judge (east) Sanaullah Khan Ghauri and informed him that she have “forgiven” the police officials after they apologised to her for unlawfully detaining her son and her nephew.

She further said that she would not seek any legal action against the police and wanted to withdraw her application. The policemen concerned were also present in the courtroom. The court after hearing the applicant’s statement disposed of the application.

The applicant, Ms Bano, had moved a habeas corpus application under Section 491 of the criminal procedure code before the court, stating that her 14-year-old son, Haider Ali, and nephew, Qurban Ali, also 14, went out of their home on May 27 but did not return. Later, Assistant Sub-Inspector Imamuddin of the Saudabad police station phoned her and said that the two boys were in police custody. She alleged that he demanded Rs50,000 for their release.

She maintained that her son and her nephew were unlawfully kept at the police station and prayed to the court to recover them.

On the directives of the sessions court, a judicial magistrate conducted a raid at the Saudabad police station on May 28 and recovered a victim from the police custody while the other was recovered from the office of the SIU (east zone), and the JM submitted a report to the sessions court stating that the boys were detained without any charge.
